ANK law firm protected interests of PE Ukrtranscontainer

On 18 October 2010 the Odessa Appeal Commercial Court announced the verdict in one of the most resonant court cases of this year. It concerns the dispute between the company Ukrtranscontainer and Illichivsk Sea Commercial Port. The resolution of the Appeal court cancelled the decision of the first court of instance, as adopted in May 2009, according to which the court terminated the joint activity agreement between the Illichivsk port and Ukrtranscontainer. The Appeal Court, reviewing the case on newly-discovered circumstances acknowledged that the agreement was terminated without sufficient legal grounds, and the violations, as revealed in the proceedings in the first instance, are not essential in understanding Ukrainian civil legislation. Thus, from 18 October 2010 the joint activity agreement between the Port and UTC is once again valid.
