Enforcement of international arbitral award in Ukraine

Lawyers of the ANK law firm acted on behalf of Evertrade (France) in a court case connected with recognition and enforcement of an international arbitral award against the Kherson Sea Commercial Port.

On January 2006 a general contract on cargo handling foreign trade and transit cargoes was concluded between Evertrade and Kherson Port. The contract provided that all disputes between the parties should be referred to the Arbitration Institute of Chamber of Commerce in Stockholm (Sweden). According to the Final Arbitration Award of the Arbitration Institute of the Chamber of Commerce in Stockholm dated 8 August 2008, Kherson Port should pay Evertarde the debt, legal and arbitration costs.

However, as Kherson Port did not fulfill the arbitral award freely, Evertrade asked for support from the ANK law firm. Lawyers submitted a motion on recognition and enforcement of the international arbitral award to the Suvorovskyi District Court of the city of Kherson.

According to the Court Ruling of Suvorovskyi District Court in Kherson, which was kept in force by a Court Ruling adopted by the Appeal Court of Kherson Region, the motion of Evertrade was fully satisfied and the Final Arbitration Award of the Arbitration Institute of Chamber of Commerce in Stockholm, which provided for collecting of the debt from Kherson Port to Evertarde, was allowed to be recognized and enforced.
