Integrites - legal adviser to Philip Morris Ukraine

Integrites acted as a legal adviser to Philip Morris Ukraine, a subsidiary of one of the world's largest manufacturers of tobacco products, in a dispute against tax authorities of Ukraine. The subject of the dispute is connected with the challenging of tax notice, increasing amount of income tax payable. That notice was issued based on the finding that the taxpayer had violated tax legislation when withholding and paying repatriation tax.

As a result of legal support, Kharkov Administrative Court of Appeal has fully canceled the decision of tax authority and recognized the claims of Philip Morris Ukraine, having based its judgment on the concept of beneficial ownership.
