Obvious Benefits

For many years the absence of trust and favorable legislative background in many “new democracies”, including our own country, resulted in an outflow of cases to more developed arbitration jurisdictions. Naturally, many countries develop and promote their arbitration centers seeking to become attractive arbitration jurisdictions. In addition to obvious benefits for the arbitration communities, this is an essential step for improving investment confidence and sustainability.

The recent security and political situation in our country impacted the performance of commercial contracts and raised a wave of investment disputes resulting from the annexation of Crimea. Judicial support to international arbitration by Ukrainian courts, sensitive investment treaty claims, and the pending question of arbitral awards enforcement proceedings – this is definitely an incomplete list of issues shaping the international arbitration agenda in Ukraine. It is promising that the professional community has involved itself in the recent initiatives and development of the arbitral market.

The hero of our cover story, Ivan Mishchenko, managing partner of Trusted Advisors, was very open and honest in assessing the prospects of arbitration landscape. The latter is closely stipulated by improvements in the general environment for doing business in Ukraine.
